Terms of Use & Intellectual Property Policy

Please read these Terms carefully. They govern access to and use of the public websites, pages, publications, downloads, tools, forms, and other online materials operated by Delta Arc, LLC. These Terms are intended to protect Delta Arc's original work while preserving rights that applicable law does not permit a private agreement to eliminate.
1. Operator, scope, and acceptance
The website at thedeltaarc.com and the materials made available through it (collectively, the “Site”) are operated by Delta Arc, LLC (“Delta Arc,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms to the extent enforceable under applicable law. If you use the Site for a company or other organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Site.
Separate written agreements, product terms, order forms, or policies may govern a particular Delta Arc service or affiliated product. If a signed written agreement directly conflicts with these Terms, the signed agreement controls for its specific subject matter.
2. Delta Arc materials and ownership
As between you and Delta Arc, Delta Arc owns or controls the original expression and protectable interests in the Site and its materials, including original articles, research, analysis, reports, fact sheets, methodologies as expressed, taxonomies, commentary, editorial selection and arrangement, graphics, photographs, video, audio, software, source code, page designs, interfaces, downloadable files, data compilations, database selection and arrangement, and the coordination and presentation of those materials (collectively, “Delta Arc Materials”), except where a page identifies a third-party owner or a different license.
Delta Arc Materials may be protected by copyright, contract, unfair-competition, database, trade-secret, and other applicable laws. Copyright protection exists in original works when they are created and fixed; registration is not required for copyright to arise. All rights not expressly granted in these Terms are reserved by Delta Arc, LLC and its licensors.
Nothing in these Terms claims ownership of facts, ideas, systems, methods of operation, public-domain material, or third-party content merely because those items are discussed, cited, linked, classified, or displayed on the Site. Delta Arc does, however, reserve all rights it may hold in its original expression and in the original selection, coordination, or arrangement of materials and compilations.
3. Limited permission to use the Site
Subject to these Terms, Delta Arc grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable permission to access and display publicly available pages for your own lawful personal use or internal business evaluation. You may print or save a reasonable number of pages for that same use if you keep all attribution and legal notices intact.
You may quote brief excerpts for criticism, commentary, news reporting, scholarship, research, or ordinary citation when the use is accurate, does not imply endorsement, identifies Delta Arc as the source, and includes a direct link to the canonical Delta Arc page when online. This paragraph is a contractual permission; it does not narrow any separate right or exception available under applicable law.
4. Uses requiring prior written consent
Except for the limited permission above or a use independently authorized by applicable law, you may not use Delta Arc Materials without Delta Arc, LLC's prior written consent. Prohibited uses include:
- copying, reproducing, republishing, uploading, posting, transmitting, distributing, syndicating, broadcasting, displaying, selling, licensing, leasing, white-labeling, or commercially exploiting Delta Arc Materials;
- mirroring, framing, embedding, or presenting the Site or substantial portions of it on another website, application, feed, marketplace, report, newsletter, or service;
- modifying, translating, adapting, or creating derivative works from Delta Arc Materials where Delta Arc's authorization is legally required;
- removing, concealing, or altering authorship, source, copyright, provenance, disclaimer, or other legal notices;
- using Delta Arc Materials to create or improve a competing, substitutive, or substantially similar directory, dataset, pricing product, research library, intelligence service, publication, or commercial offering;
- misrepresenting the source of materials, impersonating Delta Arc, suggesting a sponsorship or endorsement that does not exist, or using the Site in an unlawful, deceptive, infringing, or harmful manner.
5. Automated access, scraping, datasets, and artificial intelligence
Unless Delta Arc gives prior written consent or applicable law independently authorizes the activity, you may not use bots, spiders, crawlers, scripts, browser automation, scrapers, agents, data-mining tools, bulk-download tools, or similar means to access, acquire, monitor, copy, extract, index, cache, or compile Delta Arc Materials or Site data. You may not bypass rate limits, access controls, robots instructions, authentication, technical protections, or measures intended to limit automated activity.
You may not use Delta Arc Materials, Site data, or outputs obtained from the Site to train, fine-tune, ground, benchmark, test, evaluate, retrieve for, or otherwise develop any artificial-intelligence, machine-learning, large-language-model, embedding, knowledge-graph, search, or automated decision system without a separate written license from Delta Arc, LLC. This restriction includes creation of training corpora, retrieval-augmented generation collections, vector databases, synthetic-data pipelines, model outputs that reproduce protected expression, and datasets intended for sale, licensing, publication, or competitive use.
Delta Arc grants general-purpose public search engines a limited permission to crawl and index publicly accessible Site pages solely to provide ordinary search results that identify and link users to the original pages, subject to published robots instructions and technical controls. That permission does not include republishing substantial content, creating a substitute service, building a commercial dataset, or using Delta Arc Materials for model training or model development.
6. Data, compilations, and research boundaries
Individual facts may not be owned as copyright, but a compilation may contain protectable original selection, coordination, arrangement, commentary, and expression. Site access does not grant a license to extract, reuse, or commercialize a substantial part of any Delta Arc compilation or to make repeated or systematic extractions that substitute for the Site or its products.
Delta Arc research may combine original analysis with public, licensed, user-supplied, or third-party information. Citations and source links identify evidence and provenance; they do not transfer ownership of third-party material to Delta Arc, and they do not imply that a cited party endorses Delta Arc or has reviewed Delta Arc's analysis.
7. Lawful exceptions and third-party rights
Nothing in these Terms is intended to prohibit fair use, public-domain use, or any other right, limitation, or exception that cannot lawfully be restricted. Whether a particular use qualifies for an exception depends on the applicable law and the facts. You remain responsible for evaluating and documenting your use.
Third-party names, logos, quotations, images, data, products, and other materials remain the property of their respective owners. Your use of third-party material may be governed by that owner's terms and applicable law. No license to third-party material is granted by Delta Arc unless expressly stated.
8. Submissions, inquiries, and feedback
You retain any rights you hold in material you submit through a form or email. You grant Delta Arc a non-exclusive, worldwide, royalty-free license to host, copy, transmit, and use that material only as reasonably necessary to receive the submission, respond to you, evaluate the requested work, provide a requested service, maintain security and records, and comply with law. You represent that you have the right to submit the material and that doing so does not violate another person's rights or law.
Do not send confidential, proprietary, export-controlled, regulated, or highly sensitive information unless Delta Arc has agreed in a signed writing to receive it under specific confidentiality terms. An unsolicited submission does not by itself create a fiduciary, advisory, attorney-client, partnership, employment, or confidential relationship.
9. Informational purpose; no professional advice
The Site provides market, industrial, machinery, pricing, revenue, data, and related intelligence for educational and informational purposes. It is not financial, investment, legal, tax, accounting, appraisal, engineering, safety, trading, betting, or other regulated professional advice; it is not a recommendation, guarantee, or solicitation. Delta Arc is not acting as your broker-dealer, investment adviser, financial planner, appraiser, attorney, accountant, engineer, or gaming operator. You are responsible for independent verification, professional advice, due diligence, and decisions appropriate to your circumstances.
10. Third-party sites and services
The Site may link to or describe third-party websites, products, platforms, associations, regulators, marketplaces, or services. Links are provided for reference and convenience. Delta Arc does not control third-party services and is not responsible for their availability, accuracy, security, privacy practices, terms, or content. A link, citation, or profile does not by itself constitute affiliation, sponsorship, approval, or endorsement in either direction.
11. Security, access, and changes to the Site
You may not attempt to probe, scan, or test a vulnerability; interfere with Site operation; introduce malicious code; gain unauthorized access; overload infrastructure; forge headers or identifiers; or use the Site to violate another person's rights. Delta Arc may monitor use, preserve records, restrict automated traffic, suspend access, modify or discontinue features, and take reasonable technical or legal measures to protect the Site, users, systems, and rights.
12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND DELTA ARC MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” DELTA ARC DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, AVAILABILITY, AND RESULTS.
Markets, prices, specifications, laws, platform features, and third-party information change. Delta Arc does not warrant that every page will be current, error-free, uninterrupted, or suitable for your purpose. Corrections and updates may occur without notice.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DELTA ARC, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY; OR DAMAGES ARISING FROM RELIANCE ON SITE CONTENT, THIRD-PARTY SERVICES, UNAUTHORIZED ACCESS, INTERRUPTION, OR INABILITY TO USE THE SITE.
To the maximum extent permitted by law, Delta Arc's aggregate liability arising out of or relating to the public Site or these Terms will not exceed the greater of the amount you paid Delta Arc specifically for the Site service giving rise to the claim during the twelve months before the event or one hundred U.S. dollars (US $100). Some jurisdictions do not permit particular exclusions or limitations, so those provisions apply only to the extent permitted by law.
14. Responsibility for misuse
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Delta Arc, LLC and its owners, officers, employees, contractors, licensors, and agents from third-party claims, liabilities, damages, judgments, losses, and reasonable costs arising from your unlawful use of the Site, your material breach of these Terms, or material you submit that infringes another person's rights. This obligation does not apply to the extent a claim results from Delta Arc's own unlawful conduct.
15. Enforcement and remedies
Delta Arc may suspend or terminate access, revoke permission, block automated systems, preserve evidence, send removal or cease-and-desist demands, notify service providers, and pursue other remedies available under contract, copyright, or other applicable law. You acknowledge that unauthorized copying, disclosure, automated extraction, or commercial exploitation may cause harm that money alone cannot fully remedy, and that Delta Arc may seek injunctive or equitable relief where legally available. No delay in enforcement waives a right.
16. Permission requests and copyright concerns
For republication, commercial use, data licensing, automated access, model-development rights, or other permission, email bronto@thedeltaarc.com with the material, URL, proposed use, audience, distribution method, and duration.
If you believe material on the Site infringes your copyright, send a written notice to bronto@thedeltaarc.com identifying the protected work, the challenged Site material and exact URL, your contact information, the basis of your claim, and a statement that the information supplied is accurate. Delta Arc may request additional information before acting. This contact process does not represent that Delta Arc has appointed or registered a statutory copyright agent.
17. Changes to these Terms
Delta Arc may update these Terms by posting a revised version and changing the effective date. Changes apply prospectively when posted unless law requires a different process. Materially different terms for a paid or separately contracted service may require additional notice under the agreement governing that service.
18. Miscellaneous
If a provision is held invalid or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain in effect. Headings are for convenience only. Delta Arc may assign these Terms in connection with a reorganization, financing, merger, sale of assets, or transfer of the Site; you may not assign them without Delta Arc's written consent. These Terms, together with policies and written terms expressly incorporated by reference, form the entire agreement regarding public use of the Site.
These Terms are governed by applicable United States law and the law of the state in which Delta Arc, LLC is organized, without regard to conflict-of-law rules, except where mandatory law provides otherwise. Any dispute not governed by a separate signed agreement must be brought in a court of competent jurisdiction where Delta Arc, LLC maintains its principal place of business, unless applicable law requires another forum.
