Evidence Brief · DA-EB-LOG-001

What FMCSA Carrier Records Can and Cannot Establish

Operating authority, insurance filings, safety ratings and SMS data are separate records; active authority is not a safety rating.

Evidence, not advice. This brief does not determine the safety, compliance, authority or insurance status of any carrier, and it does not recommend any carrier, broker or course of action. A qualified reviewer would be a transportation regulatory attorney or a former FMCSA safety investigator familiar with Parts 385 and 387 and the Motus transition. This brief has not had that review.

Question

Which question does each public FMCSA carrier record answer, and which questions does it leave open?

Who can use this

  • Shippers, compliance staff, researchers and analysts who need to know what a public federal record does and does not state before relying on it in their own review.
  • Writers and data teams who need to describe these records accurately and keep the fields distinct.

Chronology

  1. 1986-10 SAFER Help states that from this month motor carriers were assigned a safety rating based on a Safety Review or a Compliance Review.

  3. 2017-01-14 Effective date of the suspension of 49 CFR 387.301 noted in the eCFR text, with a parallel section 387.301T also shown.

  5. May 14, year not printed Licensing and Insurance notice states that current registration functionality will be permanently retired, with and states that users who have not completed updates must wait for the Motus launch the following week.
  6. 2026-09-18 DataQs states revised requirements for State data reviews are in effect as of this date.
  7. 2026-09-25 SMS states its data are current as of this date.
  8. 2026-10-05 SMS states its website was updated on this date.
  9. Week of 2026-11-09 SMS states its next update falls in this week.

Source text: “Readers should not draw conclusions about a carrier's overall safety condition simply based on the data displayed in this system.”

C-14 The public SMS view of property carriers is incomplete; the notice attributes the limits to the FAST Act of 2015. Federal Motor Carrier Safety Administration
Source text: “however, the Crash Indicator and Hazardous Materials Compliance BASICs remain hidden from public view.”

C-15 The SMS site directs readers to SAFER for safety ratings and to the Licensing and Insurance site for licensing and insurance status. Federal Motor Carrier Safety Administration

C-19 The snapshot defines the ACTIVE status by reference to the USDOT number. Federal Motor Carrier Safety Administration
Source text: “The entity's US DOT number is active.”

Derived

C-24 On the as-of date, the public SMS data date was 38 days old. Federal Motor Carrier Safety Administration
Basis: Data current as of September 25, 2026 on SRC-04, counted to 2026-11-02.

Inferred

C-20 USDOT status, operating authority, insurance filings, safety rating and SMS data answer different questions, and none of the five can stand in for another. Federal Motor Carrier Safety Administration, Federal Motor Carrier Safety Administration, Office of the Federal Register, via eCFR API, Office of the Federal Register, via eCFR API, Office of the Federal Register, via eCFR API
Basis: C-01 through C-04 separate the number from authority, C-05 and C-06 place authority and financial responsibility in separate rules, C-08 ties the rating to a compliance review, and C-12 and C-15 separate SMS from ratings and licensing records.

C-21 The word active in the snapshot operating status refers to the USDOT number, and neither that value nor an authorized status states a safety rating, which arises from a different process. Federal Motor Carrier Safety Administration, Office of the Federal Register, via eCFR API
Basis: SRC-02 defines ACTIVE by the USDOT number (C-19) and the authorized status by the operating authorities listed, while C-08 and C-09 show a rating arises from a compliance review and may not exist at all. No source read equates the two.

C-22 A blank or unrated safety field cannot be read as either favorable or unfavorable, since it can mean only that no rating was assigned. Office of the Federal Register, via eCFR API
Basis: C-09 defines unrated as the absence of an assigned rating, and C-10 shows that some examinations do not produce one.

C-23 The SMS sentence that a carrier without an unsatisfactory rating or discontinuation order is authorized to operate cannot by itself be taken as confirmation of operating authority or financial responsibility. Federal Motor Carrier Safety Administration, Office of the Federal Register, via eCFR API, Office of the Federal Register, via eCFR API
Basis: The sentence appears in a notice about use of SMS data (C-13), while C-05 and C-06 impose separate authority and financial responsibility conditions, and C-15 sends readers elsewhere for licensing and insurance status.

C-25 The May 14 retirement date on the Licensing and Insurance notice most likely refers to 2026, though the notice does not print a year. Federal Motor Carrier Safety Administration
Basis: The notice pairs Thursday with May 14, and May 14, 2026 fell on a Thursday. The site still served the notice and a search menu on 2026-11-02, so the live status of each function was not established.

Limits and unknowns

  • No individual carrier record was opened or assessed, so this brief describes record types and definitions only.
  • The field wording conflicts in tone: SAFER Help describes ratings by evidence of non-compliance in records, while 49 CFR 385.3 defines them by the adequacy of safety management controls. The regulation is the legal text, and the help page may be older.
  • SAFER Help shows signs of age: it says there are five inspection levels and lists six, and it ties the national out-of-service average to 1999.
  • SAFER Help cites 49 CFR 390.19(b)(4) for inactive USDOT numbers, while the eCFR text read for section 390.19 is headed for certain Mexico-domiciled motor carriers. The relationship was not resolved here.
  • The eCFR shows 49 CFR 387.301 as suspended alongside a section 387.301T. Which version governs a given situation is a legal question this brief does not answer.
  • The Licensing and Insurance notice describes retirement of registration functions, but the site still responded on 2026-11-02. The Motus site did not respond to automated requests, so the transition could not be examined directly.
  • The DOT Data Portal lists parallel series with similar names and different refresh dates. When read, one Insur - All With History series showed rows updated 2026-11-02 and another 2023-12-06, so a dataset name alone does not establish freshness.
  • An insurance record shows what was filed or published. It does not establish coverage terms, exclusions, or whether a policy would respond to a loss.
  • Pages at www.fmcsa.dot.gov, www.bts.gov, www.maritime.dot.gov and registry.faa.gov returned 403 to automated requests and were not used. FMCSA's own registration guidance is therefore absent from this brief.
  • Title 49 U.S.C. sections were not opened. References to them appear only as they are cited in the pages read.
  • The maritime source is a January 2022 list and does not describe the present fleet. No air, rail, ocean or freight flow source here measures capacity available on a given day.

Prohibited uses

  • Any statement, ranking or inference about a named carrier, broker or freight forwarder.
  • Any safety, fitness or compliance determination, or presenting active authority as evidence of safety.
  • Brokerage, carrier selection, insurance or legal advice, including negligent selection or liability conclusions.
  • Treating SMS data, percentiles or alerts as a federal safety rating.
  • Presenting this brief as a substitute for the live federal record or for qualified review.

Safe outputs

  • A plain explanation that USDOT number, operating authority, insurance filing, safety rating and SMS data are separate records.
  • A checklist of which public source holds which record type, with its stated date.
  • A statement that an unrated status means no rating has been assigned.
  • Dated citations of FMCSA notices about SMS data use and the Licensing and Insurance transition.
