Evidence Brief · DA-EB-OPS-001

Click to cancel: final, effective, then vacated

The FTC's 2024 Negative Option amendments moved from proposed to final, effective and vacated, with a stay denied along the way.

Evidence, not advice. This brief does not determine whether any rule applies to any person, whether any practice is lawful, or whether any court ruled correctly. A qualified reviewer would be a US-licensed attorney practicing federal administrative law. This brief has not had that review.

Question

What can the official record support saying about a published federal rule's status on a given date, using the FTC's 2024 Negative Option Rule amendments as the documented example?

Who can use this

  • Business operations and research teams checking how a status label on a federal rule is documented before repeating it.
  • Editors and analysts preparing a dated question for qualified counsel about a rule's record.

Chronology

  1. 1973-02-22 The original rule was published at 38 FR 4896, as cited by the agency and the court. That document was not opened for this record.
  2. 2019-10-02 The agency published an advance notice seeking comment on the need for amendments, with a deadline of December 2, 2019.
  3. 2023-04-24 Proposed amendments were published at 88 FR 24716, with a comment deadline of June 23, 2023. Status label: proposed.
  4. 2023-12-08 A notice scheduled an informal hearing for January 16, 2024.
  5. October 2024 The court's opinion states that the agency amended the 1973 rule by a 3-2 vote in this month.
  6. 2024-11-15 The final amendments were published at 89 FR 90476. Status label: final, not yet effective.
  7. 2025-01-14 The stated effective date arrived. The eCFR version record lists amended part 425 sections with this date. Status label: effective, with a later compliance date for sections 425.4 through 425.6.
  8. Not dated in the opinion; before 2025-07-08 The Eighth Circuit denied a motion to stay the rule pending judicial review. Status label: stay requested and denied.
  9. 2025-05-09 According to the court, the agency deferred the compliance deadline from May 14, 2025 to July 14, 2025, as an exercise of enforcement discretion.
  10. 2025-07-08 The Eighth Circuit granted the petitions for review and vacated the amended rule. Status label: vacated.
  11. 2026-02-12 A final rule restored the earlier text of part 425, effective on publication. Status label: earlier text recodified.
  12. 2026-03-13 The agency published a new advance notice of proposed rulemaking, with a comment deadline of April 13, 2026. Status label: new process at the advance notice stage.

Derived

C-19 Publication of the proposal to publication of the final rule took 571 days, and 60 days separated final publication from the stated effective date. Federal Trade Commission, published in the Federal Register, Federal Trade Commission, published in the Federal Register
Basis: Calendar arithmetic on April 24, 2023, November 15, 2024 and January 14, 2025, as dated in the cited documents.

C-21 The eCFR version record shows sections 425.3 through 425.9 with a version dated 2025-01-14 not marked removed, and a next version dated 2026-02-12 marked removed. Office of the Federal Register, eCFR, US Court of Appeals for the Eighth Circuit
Basis: Direct reading of the date and removed fields in the version history, compared with the July 8, 2025 vacatur in C-07.

C-22 Federal Register metadata for the final rule continues to report an effective date of 2025-01-14, and the record as returned makes no reference to the vacatur. Office of the Federal Register, US Court of Appeals for the Eighth Circuit
Basis: Direct reading of the effective_on and dates fields in the document record, compared with C-07.

Inferred

C-23 On this record, a stay request and a stay were different events: a stay was sought and denied, the effective date passed, and the later end to the amendments came through vacatur. Federal Trade Commission, published in the Federal Register, US Court of Appeals for the Eighth Circuit
Basis: Comparison of C-03 and C-05 with C-07.

C-24 Effective date and compliance date were separate facts, and the compliance date moved through a route other than a revised date in the published final rule. Federal Trade Commission, published in the Federal Register, US Court of Appeals for the Eighth Circuit
Basis: Comparison of C-03 and C-04 with the court's account of the deferral in C-06. The agency statement itself was not read.

Limits and unknowns

  • This is one example. It does not establish how status changes unfolded for any other rule or agency.
  • The opinion does not date the stay denial or state its reasoning, and the stay order itself was not read.
  • The May 9, 2025 agency statement deferring the compliance deadline was not read, because ftc.gov returned 403. The deferral is recorded only through the court's description.
  • Difference between sources: the final rule ties the May 14, 2025 compliance date to sections 425.4 through 425.6, while the opinion describes that date as set for all regulated entities.
  • Difference between sources: the opinion dates the amendment to a 3-2 vote in October 2024, while the Federal Register publication date is November 15, 2024. The vote record was not read.
  • The March 2026 notice's statement that the vacatur reinstated the prior version is the agency's account, not a statement read in the court's order.
  • A Federal Register search for later FTC documents using the term negative option returned three notices dated July to October 2026, none of them a rule document for part 425. One, FR Doc. 2026-20971 of October 14, 2026, proposes to reinstate information collections for the rule as written before the vacatur; it was read only in part and is not a source for any claim here. The outcome of the March 2026 comment process is unknown.
  • ftc.gov, regulations.gov and bls.gov returned 403 to automated access and were not used. The rulemaking docket and any BLS series are therefore absent.
  • US Code text is the 2023 edition on GovInfo. No later amendment was checked. The court's procedural holding rests on the FTC Act, whose text was read here only as quoted in the opinion.
  • The record does not address state law, other federal authority or any enforcement activity outside the cited documents.

Prohibited uses

  • Legal advice or a compliance ruling for any person, business or program.
  • Any statement about whether a particular subscription or cancellation practice is lawful.
  • Treating this chronology as the current status of any other federal rule without reading that rule's own record.
  • Presenting the agency's or the court's terms as interchangeable without noting the source of each term.

Safe outputs

  • A dated chronology of this rule's documented status steps, with each step tied to its source.
  • A statement that, in this example, a denied stay, a stated effective date and an eCFR version entry did not by themselves show the later vacatur.
  • A reading checklist naming document types to consult when describing a rule's status: proposal, final rule, court orders, later agency action and CFR history.
